§ 38-41. Adoption by reference.

(a)

There is hereby adopted by reference the 2012 Arkansas Fire Prevention Code (AFPC).

(b)

No structure shall be constructed, renovated, or maintained, and no activity shall be undertaken, in the city except in full compliance with the Arkansas Fire Prevention Code and its state-adopted appendices and references, as it may be amended from time to time upon receipt of promulgation from the Director of the Arkansas State Police as directed by State Statute. Any person owning or in control of a structure, or undertaking an activity, which is within the city and is in violation of the terms of the Arkansas Fire Prevention Code, shall be deemed to have violated this Municipal Code.

(c)

Whenever the Arkansas Fire Prevention Code shall appear to be in conflict with any provision of this Municipal Code, the more restrictive regulation shall govern.

(d)

Sections 38-41 and 38-42 shall be deemed to adopt and incorporate subsequent state-adopted versions of the Arkansas Fire Prevention Code unless a contrary intention is indicated.
